Report: Tracking Device Sought For Child Abuse Suspect

BOULDER, Colo. -- A father accused of killing his young son will not go on trial next week and he will not have to wear a Global Positioning System tracking device, at least for now.Alex Midyettem 28, is out of jail on a $750,000 bond. On Monday he cashed a large check that paid for his wife's bond. The bond was returned since his wife is now in jail, convicted of child abuse.Prosecutors are concerned Midyette is a flight risk so they asked for GPS tracking. The Boulder judge delayed ruling on that until next Tuesday.
Midyette was scheduled to go on trial next Monday but the trial has now been moved to May 27.The Longmont man was arrested last May, accused of inflicting fatal injuries on his 10-week-old son in March 2006.Molly Midyette was found guilty in December of child abuse resulting in death, after a two-week trial. She will be sentenced on Feb. 29 and her husband's attorneys wanted the trial for Alex Midyette to begin two to three months after that date to ensure the case has been out of the news for some time.
