AURORA, Colo. -- Lawyers for the child who lost his mother, father and only brother in a crash after a fireworks show have filed a wrongful death lawsuit.Tyler O'Neil was the only survivor of the crash in Aurora on July 4.He was 2 years old at the time.
His mother and father, Karen and William O'Neil, and his older brother, Trevor, died at the scene. Bystanders who saw the crash heard cries coming from the family's car and ran up to see Tyler still strapped in his seat. They used a knife to cut him out.Aurora Police investigators told 7NEWS at the time of the accident, a Ford F-650 tow truck and a Honda SUV collided in the northbound lanes of South Chambers Road near East Louisiana Avenue. The tow truck then crossed into the southbound lanes, where it collided with another vehicle and the O'Neil's Chrysler 300M.The lawsuit, filed in Denver County District Court on behalf of Tyler O’Neil, requests monetary damages as a result of the wrongful actions of John’s Towing, Inc. and the driver of the tow truck, Cynthia Charlebois.The complaint alleges that the defendants wrongfully caused the deaths of Tyler’s family including his mother, father, and only brother.According to the attorneys, Charlebois was charged with three counts of careless driving resulting in death and two counts of careless driving resulting in serious bodily injury. The attorneys also say Tyler O’Neil is still recovering from the serious injuries he received in the collision.Distraught neighbors described the O'Neils as a loving, all-American family. They said Karen was always outside, watching her kids play in the yard. William O'Neil, they said, would watch for cars when his kids played with other children on the street.
