Death Penalty Ruled Out In Greeley Ambush Slaying

Shawna Nelson Faces First-Degree Murder Charge

A woman accused in the ambush killing of a Greeley, Colo. police officer's wife will not face the death penalty, prosecutors have announced.

Shawna Nelson, 35, is charged with first-degree murder in connection with the Jan. 23 slaying of Heather Garraus, 35, the wife of former Greeley police officer Ignacio Garraus.

Nelson said she gave birth to a baby boy as a result of the affair. At the time Nelson was married to former Weld County Sheriff's investigator Ken Nelson.

Both Ken Nelson and Ignacio Garraus resigned their jobs and have moved from the area.

According to investigators, Shawna Nelson waited outside the workplace of Heather Garraus and shot her twice in the parking lot. Nelson was arrested a short time later.

A spokeswoman for the Larimer District Attorney's Office would not explain why prosecutors would not seek the death penalty in the case. Larimer County is handling the prosecution to avoid a conflict of interest for Weld County prosecutors, since several of the people involved in the case are law enforcement officers.

Nelson was arrested near her home a short time later and a face mask was recovered from the pickup truck she was driving.

Nelson is being held without bail in the case. If found guilty of first-degree murder, she faces mandatory life in prison.
