Midyettes Make First Boulder Court Appearance

A Boulder County couple accused of causing their infant son's death made their first appearance in court Wednesday.

Alex and Molly Midyette surrendered to police Tuesday afternoon after a grand jury indicted them on seven counts of child abuse.

Grand juries met for seven months before returning an indictment. They began meeting last October, seven months after 10-week-old Jason Midyette died of head injuries.

The indictment alleges that Alex Midyette, 27, and his wife Molly Midyette, 28, killed their child, placing him in a threatening situation and mistreating him over a period of two months.

The couple said nothing as they left Boulder District Court Wednesday after being formally charged. They Midyettes have not spoken to police, nor have they spoken publicly about the case.

Alex Midyette is accused of causing injuries to the boy that resulted in his death.

Jason Midyette was hospitalized with severe injuries in late February 2006. He was taken off life support a week later and died. He suffered 28 broken bones and a fractured skull. A coroner ruled his death a homicide.

According to the indictment, Alex Midyette admitted to accidentally hitting the boy's head on a chair and table.

Doctors later testified that injuries to the baby's mouth were consistent with child abuse, and friends and family members allegedly saw bruises on his body, the indictment said.

Boulder District Attorney Mary Lacy has been questioned about the handling of the investigation by people in talk radio. She wouldn't comment Wednesday about the case.

Alex and Molly Midyette's next hearing is set for July 10.
