Murder, Child Abuse Charges Dropped Against College Student
Addie Kubisiak Still Faces Misdemeanor Charges In Case

CASTLE ROCK, Colo. -- Charges of first-degree murder and child abuse were dropped Friday against Addie Kubisiak.Prosecutors had originally charged her after the decaying body of an newborn was found in her dorm room at Western State College in Gunnison. Gunnison police were tipped off by students who reported smelling a foul odor.Kubisiak allegedly gave birth in her car in Douglas County in late November. Prosecutors said they believe she took the infant to her home in Parker and then transported it to her dorm room in Gunnison, which is about five hours away.
On Friday, prosecutors said they couldn't prove the infant was born alive.Kubisiak could have received life in prison or the death penalty if she had been convicted of first-degree murder. A child abuse conviction meant she could have spent eight to 24 years in prison.Kubisiak faces a misdemeanor charge of concealing a death in connection with the case. The charge carries a penalty of up to 18 months in jail, if Kubisiak is found guilty.Outside the courtroom Friday, her father, Tom, thanked everyone who had offered prayers for his daughter and the family.
