Jeffco Jury Finds Priest Guilty Of Sexual Assault

Timothy Evans To Be Sentenced In May

A Catholic priest accused of molesting a teenager at his parish was found guilty of sexual assault on a child by one in a position of trust.

Timothy Joseph Evans' conviction on Monday comes just two weeks after a similar ruling in another case at another parish in Fort Collins.

Evans, 44, was accused of fondling a 16-year-old boy between 1995 and 1997 while he was assigned to the Spirit Of Christ Catholic Community Church in Arvada.

The 16-year-old had been referred to Evans for counseling by his parents in 1996. The teen was questioning his religious beliefs and, as part of his research, checked out a book from a local library on the satanic bible. The teen's father, who was active in church, found the book in his backpack and suggested that he meet with Evans.

The teen met with Evans for guidance and counseling and during the meeting, Evans suggested that he lie on the floor, according to prosecutors.

The teen, who said he was wearing a T-shirt and shorts at the time, told investigators that Evans began touching him and rubbing his chest. Evans commented that the teen had a "barrel chest" and rubbed his chest, arms, thighs and calves, the victim said.

The victim alleges that Evans rubbed up his leg and ultimately touched his scrotum, which made him feel "flush" and made him jump because he was "scared," according to the original indictment.

The victim, who is now a grown man, talked to 7NEWS after the verdict was delivered.

"It has been hard. It's been hard to go through this whole process," said the victim, who is identified only as Damon. "To me, it's actually extremely rewarding to get to the final point of a guilty verdict, you know? To know that the things that he's done and the way that he's destroyed people's lives -- that's ultimately going to be paid for in the end."

He said that he will be dealing with this for the rest of his life. "I think people think about the contact, the physical contact as the only part of the crime, and it's not. It's so much more than that," he said. "It's the way that they affect the way you think and how you are and they way you think about yourself."

Bob Brancato with Bikers Against Child Abuse was at the trial to support the victims and said the verdict will save other children from abuse.

"The jury understood how this individual, under the realm of being a priest, had not only taken the victims innocence away, he had stripped them of that initial trust in God," Brancato said. "And the courage of these victims to step forward, to take the stand and testify, to tell everything that happened is tremendous."

During the trial, the Jefferson County jury also heard about three incidents of similar conduct with other young men -- two teens and a youth pastor at the parish where Evans was assigned, prosecutors said.

Evans was convicted in Fort Collins last month of sexually assaulting a young parishioner at the St. Elizabeth Ann Seton Parish, where Evans served from 1998 to 2002. Evans is scheduled to be sentenced in that case in May.

He will be sentenced on May 31 in the latest case from Arvada. He faces up to eight years in prison.

Evans was removed from the priesthood in 2003, after the charges came out.

One alleged victim told police that the diocese moved Evans from the Arvada church to the Fort Collins church "due to an incident where Father Timothy Evans inappropriately touched a juvenile male."

But the Archdiocese has disputed the claim.

"As these judicial proceedings conclude, I offer my prayers that a process of healing might begin. For those who have been hurt by Timothy Evans, I express my deep sorrow and pray for your healing and peace. I also pray for the families and church communities that have been affected by these sad events. I also pray for Timothy Evans and his family," said Rev. Charles J. Chaput, Archbishop of Denver.

"In both court proceedings, officials of the Archdiocese of Denver testified to promptly reporting the allegation of sexual abuse of a minor to law enforcement authorities. Immediately following the first allegation of sexual abuse of a minor in 2003, Fr. Timothy Evans was removed from ministry in the Archdiocese of Denver. These actions reflect long-standing Archdiocesan policies. The Archdiocese of Denver does not permit any priest to minister with a credible claim of sexual abuse of a minor against him. We remain committed to these policies."

Victims' advocates said they hope Evans' two convictions serve as an example to all victims of sexual abuse that they have nothing to fear when they come forward against members of the clergy.

"The courage of these victims to step forward, to testify, to tell everything that happened, is tremendous," said Bob Brancato, with Bikers Against Child Abuse.

"We are grateful for the guilty verdict in the Jefferson County Timothy Evans trial, because it will help keep kids safe. We are also grateful to the brave survivor who found the courage to come forward and the wisdom to report to police, instead of church officials," said Jeb Barrett, with the Denver chapter of Survivors Network of those Abused by Priests (SNAP).

"We hope this finding will begin to bring some healing and closure to all of Evans' victims. Still, they will face a long, hard road toward recovery, and we wish them the very best. Our unsolicited advice to them is to stay in therapy, recovery programs and support groups, and to realize that no one event, even a criminal conviction, can magically reverse or end years of deep pain."
