No Bond For Man Accused Of Killing 2 In Apartment Fire

A man being held in a deadly apartment fire told his ex-girlfriend that he wanted to put their 6-month-old girl on a barbecue grill and burn her, according to an arrest affidavit released Wednesday.

A judge set bond at $10,000 for Gene Johnson, 37, who was arrested along with cousin Derrick "Nicky" Johnson, 23, of Fountain. They were taken into custody shortly after an arson fire on Jan. 16 that destroyed a 135-unit apartment complex and killed two people.

Joe Santoyo, 52, and Clemente Perez Salgado, 32, were killed in the Castle West Apartment fire.

Derrick was being held without bond and faces nine felony charges including first-degree arson, first-degree murder and attempted first-degree murder.

Gene was charged with being an accessory after the fact. Investigators suspect he helped his cousin flee after the fire started in the building, Chief Deputy District Attorney Lisa Kirkman said. Kirkman said police found no evidence that Gene helped start the fire.

Derrick's two brothers and a woman were also arrested on charges of accessory to first-degree murder. They tried to cover for Derrick by telling investigators that he was at a party all night and couldn't have started the fire, police said.

Police have said the fire may have stemmed from a domestic dispute between Derrick and the mother of his child. The woman and baby, who were at the apartment building, survived the fire.

According to a police affidavit, the woman's friend told investigators that before the fire, the woman received phone calls and text messages from her former boyfriend threatening to kill her and the 6-month-old baby. He also threatened to "blow up" the apartments, the affidavit said.

The friend told police that she heard Derrick threatening to kill the baby by "torturing it and then putting it on the barbecue grill and burning it," according to the affidavit.

He then said he was on his way over to the apartments to kill them both, and the fire started about 45 to 60 minutes later, she said.

The friend said that Derrick was upset with his ex-girlfriend because she had left him. She said that the woman had received threats for some time but that she felt that he was just talking and wasn't actually planning on doing any of those things.

The friend then said that she and the victim and the child were all sleeping in the living room when she saw sparks coming in underneath her front door. She then heard other people in the complex yelling that there was a fire and that's when she and others jumped off the balcony.

A witness reported seeing a man leaving the apartment complex with a gas can, just before the fire. When a detective went to arrest Derrick and transport him to the El Paso County jail, he said, "I'll give you some stuff. I'll show you where the gas can, the socks, and the hat is."

However, Derrick claims that it was his cousin Gene who got the gas can, poured gas on the building and started the fire. According to his affidavit, he said he was sitting in the car when he heard a large "swooshing sound" and saw a large plume of smoke rise from the building.

After further investigation police now believe that Derrick started the fire even though Gene spent six weeks in jail without bond on suspicion of first-degree murder.

Firefighters said they knew immediately the fire was suspicious because of "the speed that the fire spread throughout the complex." Dozens of families are still displaced from the fire.

At Springs of Life Church next door to the apartment complex, a new fence now separates the apartment complex from the church property. The fence was a gift from Home Depot, Texas Roadhouse and three construction companies. It was put up to help keep asbestos on the ground from blowing into the church playground.

"They donated all the labor to put that fence up and all the materials to put that fence up. The whole fence was put up in one day. Beginning to end in one day," said Springs of Life Church pastor Dan Finnegan.

The apartment complex will eventually be demolished. Some residents have expressed a desire to retrieve some of their belongings, so officials are in the process of determining how much is salvageable without jeopardizing health and safety.
