Judge Refuses To Make Files Public In Newborn's Death
Infant Homicide Court Files To Remain Closed

CASTLE ROCK, Colo. -- A state district judge has rejected a request to unseal court documents in the case of an 18-year-old woman facing a first-degree murder charge in the death of her newborn. The Denver Post had requested that the court file on Addie Kubisiak of Parker be made public. But Douglas County District Judge Nancy Hopf said she agrees with prosecutors and defense attorneys that releasing the documents would violate the privacy of the infant's father, who's under age 18. Douglas County investigators have said they believe Kubisiak gave birth in a car last fall, but no information about the baby's death has been released. Investigators have said they believe Kubisiak kept the baby's body in her dorm room at Western State College in Gunnison.
The judge did make public portions of the charging documents and motions filed. The original complaint in the case lists the baby's name as Tristen. Kubisiak -- who also faces charges of child abuse resulting in death and concealing a death -- is scheduled to appear in court April 2.
