A former Brighton High School teacher accused of having sex with one of her students was released from jail Monday afternoon after her husband, the school's principal, posted her bond, her attorney said.

Carrie McCandless appeared in Larimer District Court Monday morning where her bond was set at $25,000. She had been held in jail without bond after she was accused of contacting the alleged victim.

"She's very upset that she's been in custody for the last five days. Somewhat, at least, unjustly," said her attorney, Trent Trani.

McCandless faces charges of sexual assault and contributing to the delinquency of a minor. The former social studies teacher is accused of engaging in drinking, kissing and fondling with a 17-year-old male student while on a school field trip in Estes Park last fall.

When she was originally arrested, she was ordered not to have contact with the student or any other minors.

However, prosecutors allege that McCandless called the student two days after appearing in the same courtroom with him during her preliminary hearing.

Trani said prosecutors have not proven that the call the boy received was from McCandless. Trani said it came from a 415 area code and it was not anyone connected to the case.

"It was made from an individual who is not a party to the case. My position is that the district attorney has not even established, even by a proponderance of the evidence, that Mrs. McCandless made this telephone call," said Trani.

He said he believes the publicity surrounding the case may have led a prankster to call the teen.

"I think because of the amount of publicity this case has received, I think it's entirely possible that this was somebody either playing a prank on (the teen). I just don't know I guess. We just haven't seen enough (evidence). That's my problem with the whole situation," Trani said. "He has a MySpace account, that's certainly him. My point with that is he has a number of females posting on his MySpace Web site. I guess my point with that is: how do we know it wasn't one of those individuals who made this telephone call?"
