FORT COLLINS, Colo. -- Larimer County authorities have issued a new arrest warrant for former Brighton Charter School teacher Carrie McCandless after prosecutors alleged that she contacted the victim in her sexual assault case.Her attorney denied the claim, telling the Denver Post that "there's no proof."McCandless, who once taught social studies at the school, is accused of engaging in drinking, kissing and fondling with 17-year-old male student last year while on a school field trip in Estes Park. The student told police that he told McCandless he loved her and that she said she loved him.
McCandless, 30, had been released on $20,000 bond, but one of the conditions of her release was that she not contact the student. In a motion filed last Thursday, prosecutors alleged that McCandless contacted the student on Wednesday, two days after they both appeared in the same court room -- though seated far apart -- for a scheduled preliminary hearing. A 7NEWS photographer captured the two in the same hallway, walking out of court, although it was unclear whether she was talking to him at the time.Prosecutors asked the judge to revoke McCandless' bond on Thursday, and an arrest warrant, with a $25,000 bond, was issued for her on Friday.Her attorney, Michael Trani, told the newspaper that according to the arrest warrant, the boy received a call from a woman in the 415 area code who said she was McCandless. Her attorney said it wasn't her and believes the publicity surrounding the case may have led a prankster in the San Francisco area to call the teen.As of Monday afternoon, it did not appear that McCandless had been arrested or turned herself in.Spokespeople for the Brighton Police Department and the Larimer County Sheriff's Office said they don't believe their departments have received any specific requests to track down McCandless, who lives in Brighton.Documents detailing the latest contact between McCandless and the student have been sealed. Linda Jensen, a spokeswoman for the Larimer County District Attorney's Office, declined to reveal the documents' content."We don't discuss cases that are active," she said.At a scheduled preliminary hearing for McCandless earlier this month, Trani and Deputy District Attorney Michael Pierson revealed that McCandless had been offered a plea deal in the case. The preliminary hearing was postponed until February so that McCandless and Trani could consider the deal, though it is now unclear whether this new allegation will affect that plea offer.Trani has subpoenaed the victim in the case to testify at the preliminary hearing, saying that the student had not agreed to let Trani interview him. Prosecutors have asked the judge to quash the subpoena.After allegations of the sexual contact emerged, McCandless was fired from the charter school, where her husband is the principal.Brighton police have said they first learned about the allegations from a television news reporter, and Adams County prosecutors have since charged charter school president David Mundy with tampering with a witness or victim and failure to report child abuse. Details of those allegations have not been released, and Mundy has denied wrongdoing.He has resigned from the charter school board.
