UPDATED: 6:38 pm MST December 7, 2006

The office of Boulder District Attorney Mary Lacy has confirmed a grand jury was convened to investigate the March death of a 10-week-old baby.

Authorities said the baby's parents , Alex Midyette, 27, and Molly Midyette, 28, brought the eight-pound boy to a hospital on Feb. 24. The infant had 28 broken bones including a fractured skull. He died after being taken off life support 10 days later.

The Boulder County coroner's office conducted an autopsy and ruled the death a homicide. Read the Jason Midyette autopsy report (pdf)

The parents have not talked with investigators and have never been charged with a crime. They have since moved out of their home in Louisville.

The district attorney's office began presenting its case to the secret panel on Oct. 26, according to a news release.

National television personalities Bill O'Reilly and Greta Van Sustern criticized Lacy last month for not taking action in the case.
