Carrie McCandless appears in court.

Affidavit Reveals Details About Alleged Teacher, Student Affair

Investigators: McCandless, Boy Text Messaged Each Other Before Trip

POSTED: 4:30 pm MST December 6, 2006
UPDATED: 10:07 am MST December 7, 2006

The Former Brighton Charter High School teacher who is accused of sexually assaulting one of her students apparently carried on a romance with the student, the arrest affidavit revealed.

Carrie McCandless, 29, was fired from the charter school where her husband is the principal after she was charged with sexual assault on a child by a person in a position of trust. The affidavit said McCandless and the 17-year-old student exchanged 76 text messages in one day and that she provided alcohol to him while on a field trip to Estes Park in October.

McCandless is also charged with contributing to the delinquency of a minor by providing at least one student with alcohol.

The affidavit said McCandless and the boy began text messaging each other before the field trip. In one of the text messages the boy wrote that he was cold and she responded, "Just pretend you're here sweating with me."

The affidavit also said McCandless told the boy she was having problems in her marriage and that the two professed their love to each other.

While on the trip, McCandless and the boy "made out" in public areas including outside of a store and in the cabin where the students on the trip were staying, the document said.

The affidavit said at one point during the trip the boy told police that he and McCandless simulated sex with their clothes on, but that was the closest they ever got to having sex.

The affidavit said a female student saw the two "making out" when she came out of the bathroom. She told police that earlier she overheard them talking about the first time they had sex and smoked pot.

One student told police McCandless and the boy "did everything except have sex" and it was obvious to everyone what was going on.

Students told police McCandless and the boy would disappear together for 30 to 45 minutes at a time.

The boy told police that both he and McCandless brought alcohol on the trip.

The charter school has been accused of not handling the situation properly after school officials learned about the incident and did not report it to police. Police became aware of the situation when they were contacted by the media.

Former school board chairman David Mundy Sr. resigned from the board after being charged with tampering with at least three witnesses or victims and failing to report child abuse.

The affidavit alleges that on Oct. 30, McCandless' husband, Chris McCandless, who is also the principal of the school, met with her and Mundy to discuss the situation. Police said she told her husband and Mundy that the student had kissed and hugged her but that she backed away and told him it was inappropriate.

A teacher obtained a letter written between McCandless and the boy and gave it to Chris McCandless who then gave it to Mundy, the affidavit said.

According to the affidavit, the boy wrote in the note, "It was awesome, the best." McCandless reponded that she was "messed up in the head," but that ,"It's not like it was against my will...it was totally fun."

Mundy was formally charged Wednesday morning.
