Trial Of Texas Lawman On Sex Charges Now In Question

The Monday trial of a Texas constable charged with child-sex crimes in Colorado is in question, amid some uncertainty about the defendant's health.

Larry Dale Floyd, 62, faces charges of soliciting for child prostitution, enticement of a child, and attempted sexual assault on a child.

Authorities in Canon City arrested Floyd in July 2005, after he allegedly used the Internet to arrange a sexual encounter with an 8-year-old girl and traveled to Colorado to meet her.

There was no girl, and he met with an undercover police officer posing as the girl's mother in Canon City.

During a pretrial conference Wednesday, defense attorney Philip DuBois told district Judge Julie Marshall that he wanted to delay the trial because of the physical condition of his client.

"Mr. Floyd is in a wheelchair and appears to be showing signs of great suffering. He is making noises -- what one might call whimpering," Mr. DuBois said.

Floyd fell at the Fremont County Jail nearly two weeks ago and has twice been taken to the hospital for treatment, according to DuBois.

Assistant District Attorney Kathy Eberling told the judge that she has eight witnesses traveling from Texas for the trial. She accused Floyd of "malingering" and said he "even told other inmates he would try this stunt."

Eberling requested that DuBuois provide medical proof of Floyd's condition.

Marshall said she will hear more evidence Thursday before deciding how to proceed.

Floyd had been an elected law enforcement officer in the Denton County, Texas area before a county judge fired him two months ago.

He was indicted in Denton County on three felony charges of possession of child pornography. He faces two to 10 years in prison and up to a $10,000 fine on each count.

Floyd is being held on $100,000 bond in the Fremont County Jail.
