Pueblo County DA Joins Fight Against Colorado Smoking Ban

Pueblo County's district attorney said he is on the plaintiffs' side when it comes to their federal lawsuit, filed in hopes of overturning Colorado's statewide smoking ban.

On Friday, District Attorney Bill Thiebaut, through his attorney, filed a motion for a summary judgment that seeks to end the ban, which took effect July 1.

A coalition of bar and tavern owners filed the suit a month earlier to overturn the Colorado Clean Indoor Air Act.

Attorney James Carleo saud tgat Theibaut's motion claims the casino industry has been given a special exemption based solely on financial considerations, not anything related to second-hand smoke.

The suit names state officials including Governor Bill Owens, State Treasurer Mike Coffman and Colorado Attorney General John Suthers as defendants.

It's not clear when Judge Lewis Babcock might issue a ruling.
