Principal, Student Investigated After Altercation
Both Suffer Minor Injuries

AURORA, Colo. -- A Denver mother threatened legal action against the principal of North Middle School Friday, while investigators mulled over the possibility of charging her son with assault and other charges."He came up and just hit me," said Luis Estrada, 14.The 8th grader alleged the incident happened Wednesday when his school principal, Gerardo de la Garza, demanded he go to the school’s office after a problem in the lunch line.
Estrada said things escalated from there, and accused the principal of grabbing his sweatshirt and eventually using expletives."He just came and hit me on my ear. I don’t know if he hit me with his fist or the radio he had in his hand," Estrada told 7NEWS.Estrada said his left ear bled from a piercing he had, and was taken to the hospital due to dizziness and pain.“There was an incident that did involve a student and the principal,” said spokeswoman for the Aurora Public School District.Georgia Duran also said the matter was turned over to police, who are focusing their investigation on the student's actions.While unable to provide specific details, citing the open police investigation and privacy issues, Duran explained the principal’s conduct was reviewed internally.“What our investigation revealed is that there was appropriate response by our principal and we have full confidence in his abilities,” said Duran.She added de la Garza also suffered minor injuries during the incident and was back at work the following day.A call to de la Garza's home Friday was not returned.Dora Arguetta, Estrada’s mother, accused the school district of negatively portraying her son, and said she planned to seek legal counsel.“You don’t put your hands on a minor, you just don’t do it,” Arguetta said through a Spanish translator who is an intern at 7NEWS.Estrada said he had problems with the principal in the past and admitted he has a criminal record for, “fighting and tagging.”Bob Friel, spokesman for the Aurora Police department confirmed the focus of the investigation is on the student.He said potential charges could include trespassing, assault and battery, although no recommendation had been made to the district attorney.Arguetta said she had not been notified of any disciplinary action, or if her son faced suspension from the school.Duran could not comment on Estrada’s status, due to student privacy rights.
